Introduction
This Terms of Service (“Terms”) governs your access to and use of the Trust Home Loan platform and related services (“Service”) provided by THL Holdings LLC (“THL,” “we,” “us,” or “our”). These Terms form a binding agreement between you and THL Holdings LLC, located at:

By accessing or using the Service, you agree to these Terms.
1. Overview of the Service
THL provides a technology-enabled service that identifies and delivers active, first-party, opt-in consumer prospects (“Prospects”) to licensed mortgage loan officers (“LOs”). Prospects voluntarily provide their information through online forms for the purpose of being contacted regarding mortgage products, including home purchase and refinance options.
THL does not sell purchased, scraped, rented, or third-party lists.
All leads are:
Opt-in (Prospect voluntarily submitted information)
First-party (collected directly by THL)
Exclusively delivered to the specific LO customer
Delivered in near real time
LOs must use Prospect information in compliance with all applicable federal and state regulations, including but not limited to TCPA, CAN-SPAM, RESPA, and state licensing rules.
2. Eligibility
You must:
Be a licensed mortgage professional in good standing in each state where you operate.
Use the Service solely for legitimate mortgage-related outreach.
Maintain an active account with accurate billing information.
You are responsible for all actions taken through your account.
3. Acceptable Use Requirements
You agree not to:
Share, resell, syndicate, duplicate, or transfer any Prospect data provided by THL.
Use the Service for unlawful, abusive, deceptive, fraudulent, discriminatory, or harassing conduct.
Perform automated data scraping, extraction, or harvesting of the platform.
Misrepresent yourself, your business, or the nature of your contact to Prospects.
Contact Prospects using methods prohibited by law or by your licensing authority.
THL may suspend or terminate accounts that violate these Terms.
4. Prospect Data & Permissions
4.1 Opt-In Consent
Each Prospect provided through THL has affirmatively submitted:
Name
Contact information
Property and loan-related details
Permission to be contacted by a mortgage professional
THL records and maintains the form submission timestamp and source URL as part of its compliance process.
4.2 Your Responsibilities as a Loan Officer
Once received, you agree to:
Contact Prospects in compliance with TCPA, CAN-SPAM, and all state/federal regulations.
Use only manual dialing or compliant dialing solutions when contacting mobile numbers.
Honor all unsubscribe, opt-out, or “do not contact” requests immediately.
Maintain accurate records of your outreach, as required by law.
Treat the Prospect’s personal information with appropriate privacy safeguards.
4.3 Exclusivity
THL delivers each Prospect to one LO and does not redistribute the same Prospect to other customers. Exclusivity applies to the specific Prospect record as submitted, but does not prevent that consumer from submitting their information elsewhere online.
5. Ownership & Use of Content
5.1 Your Inputs
You may provide data, preferences, or configuration settings (“Input”). You retain ownership of your Input.
5.2 THL Outputs
THL assigns to you all rights in the Prospect data delivered to you, subject to:
Compliance with these Terms
Legal requirements
Prohibition on resale or redistribution
5.3 Data Integrity
THL uses commercially reasonable efforts to ensure data accuracy but does not guarantee:
The correctness or completeness of Prospect submissions
That a Prospect will be reachable or responsive
Any specific conversion, loan funding, or business performance outcomes
6. Subscription Plans, Billing & Refunds
6.1 Billing
You authorize THL to charge your chosen payment method on a recurring basis, if applicable, according to your plan. Taxes may apply.
6.2 Failed Payments
If a payment fails, THL may pause delivery of Prospects or suspend your account until payment is resolved.
6.3 Cancellation
You may cancel at any time.
All fees already paid are non-refundable, except where required by law.
6.4 Plan Changes
THL may update pricing. If so, you will receive advance notice before changes take effect on your next billing cycle.
7. Termination
THL may suspend or terminate your account if:
You violate these Terms
You misuse Prospect data
Required payment is not received
Your actions create legal, reputational, or operational risk
We must do so to comply with the law
You may appeal a termination by contacting hello@trusthomeloan.com.
8. Intellectual Property
All THL software, tools, website content, branding, and materials remain the exclusive property of THL Holdings LLC. You may not copy, reverse engineer, or distribute any part of the Service.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
THL does not warrant that:
Prospects will be contactable
Prospects will qualify for a mortgage
You will achieve any specific business result
The Service will be error-free or uninterrupted
10. Limitation of Liability
To the fullest extent permitted by law, THL’s liability for any claim arising from your use of the Service will not exceed the total amount you paid to THL in the 30 days preceding the event giving rise to the claim.
THL will not be liable for:
Lost profits or opportunities
Loss of data
Consequential or punitive damages
Consumer non-responsiveness
Regulatory penalties resulting from your misuse of Prospect data
11. Indemnification
You agree to defend, indemnify, and hold harmless THL, its owners, employees, and partners from all claims, damages, losses, liabilities, and expenses arising from:
Your use of Prospect data
Your outreach practices
Your violation of laws or regulations
Your breach of these Terms
12. Changes to Terms
We may update these Terms from time to time. Updated Terms will be posted on the website with a new “Last Updated” date. Continued use of the Service constitutes acceptance of the updated Terms.
